Trump Issues Executive Order Suspending Temporary Work Visas

President Donald Trump signed an executive order that extends and expands his April 22nd ban suspending immigrant visas and certain non-immigrant visa to the end of 2020. This proclamation will become effective at 12:01 a.m. eastern daylight time on June 24, 2020.

The entry of H-1B, H-2B, L, J (certain J), or immigrant visa is suspended and limited:

ONLY if they:

  • are outside the United States on the effective date of this proclamation
  • do not have a H-1B, H-2B, L, J (certain J), or immigrant visa that is valid on June 24, 2020
  • do not have an official travel document other than a visa (such as EAD card or an appropriate boarding foil)

The order does NOT apply to:

  • people already in the U.S (visa extension, transfer and green card are not impacted)
  • any lawful permanent outside of the U.S.;
  • anyone who has valid visa outside of U.S (those who are impacted by Trump’s May 29th Ban are not included);
  • any one seeking to enter the United States to provide temporary labor or services essential to the United States food supply chain
  • any one whose entry would be in the national interest as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designee

How to successfully obtain H-1B, H-2B, L, J (certain J) during the Ban:

  • Only H-1B, H-2B, L, J (certain J) and immigrant visa are banned, you could enter U.S. with visas that are outside of Ban scope and then transfer to H-1B, H-2B, L, or J (certain J).
