This is How We Handle H-1B Lottery for 2021 Fiscal Year

Background
On 12/09/2019, U.S. Citizenship and Immigration Services announced that employers seeking to file H-1B cap-subject petitions for the upcoming year must first register their profiles electronically before the lottery process. By doing so, they will be entered into a random selection draw, where selected petitions will then be eligible to file H-1B cap-subject petitions within 90 days of the lottery. This is a drastic change in the way that USISC has normally handled the lottery process. In the past, H-1B cap petitions would be prepared prior to the lottery and the selected petitions would continue for processing, while the others would be returned to the petitioners. The new system allows for prior electronic registration so that employers and attorneys are able to submit H-1B cap-subject petitions with full knowledge that they’ve already been selected by the lottery.

What to Expect
USCIS will open an initial registration period from March 1st through March 20th, 2020. Only those with selected registrations will be eligible to file H-1B cap-subject petitions within 90 days of the lottery. We will start the preparation of H1B application package for the clients who we help with registration and is selected in March. We also accept clients who contact us after being selected. Please be advised that you only have 90 days to prepare H1B and get it submitted. The earlier you contact with your lawyer, the better.
