Premium Processing Now Available For Some EB-1C and EB-2NIW

The USCIS as part of their efforts to increase efficiency and reduce burdens to the overall legal immigration system announced the availability of premium processing for previously filed EB-1 and EB-2 Form 1-40 Petitions. Considering the fact that this significantly expands the categories of forms eligible for premium processing services, this specific expansion only applies to certain previously filed Form I-140 petitions under an E13 EB-1C multinational executive and manager classification or E21 NIW classification as a member of professions with advanced degrees or exceptional ability seeking a National Interest Waiver (NIW.) Petitioners who wish to avail of the said expansion must file Form I-907 or Request for Premium Processing Service. A new version of Form I-907 was published dated May 23, 2022. For the month of June, the USCIS will accept both the 09/30/20 and the 05/31/22 editions of Form I-907.  However, Starting July 1, older 09/30/20 editions of Form I-907 will not be accepted.

The USCIS likewise announced the phased approach implementation of the said expansion which shall proceed as follows:

  • Beginning June 1, 2022, the USCIS will accept Form I-907 requests for E13 multinational executive manager petitions received on or before January 1, 2021.
  • Beginning July 1, 2022, the USCIS will accept Form I-907 requests for E21 NIW petitions received on or before June 1, 2021, and E13 multinational executive and manager petitions received on or before March 1, 2021.

Moreover, the USCIS further directed that premium processing requests for the abovementioned classifications that are filed before their start date of June 1, 2022, or July 1, 2022 shall be rejected and that new initial Forms I-140 with a premium processing request shall not be accepted at this time.
