Biden’s New Executive Order
Providing 500,000 noncitizen spouses of U.S. Citizens pathway to green cards without Leaving the U.S.
This is one of the biggest developments in immigration in the past decade. On June 18, 2024, the Biden administration announced an executive order allowing noncitizen spouses who entered the U.S. illegally to apply for green cards without leaving the country if they marry U.S. citizens. This new policy transforms the current requirement that these noncitizen spouses stay outside the U.S. for years while awaiting green card approval to reunite with their families. Once enacted, the order will enable families to stay together during the green card processing. This policy will prevent the deportation of undocumented spouses of U.S. citizens, grant them work permits, and offer them a route to citizenship.
These are the conditions:
- They have resided in the U.S. for over 10 years.
- They do not pose any public safety or national security risks.
- They qualify for status adjustment.
- They warrant a positive discretionary decision.
In addition, to be evaluated individually under this new process, an applicant must meet the following criteria:
- Currently reside in the U.S. without having been admitted or paroled.
- Have maintained continuous presence in the U.S. for a minimum of 10 years by June 17, 2024.
- Be legally married to a U.S. citizen as of June 17, 2024.
