NEWS!!! EAD Automatic Extension for 540 days, are you eligible?

    USCIS has introduced a temporary final rule (TFR). This change extends the automatic extension period for expiring Employment Authorization Documents (EADs) from up to 180 days to up to 540 days for certain EAD renewal applicants who have submitted Form I-765, Application for Employment Authorization, in a timely and proper manner. The following EAD categories are eligible for the 540-day automatic extension:

  • Refugee (a)(3)
  • Asylee (a)(5)
  • N-8 or N-9 (a)(7)
  • Citizen of Micronesia, Marshall Islands, or Palau (a)(8)
  • Withholding of Deportation or Removal Granted (a)(10)
  • Temporary Protected Status (TPS) Granted (a)(12)
  • Spouse of principal E nonimmigrant with an unexpired I-94 (a)(17)
  • Spouse of principal L-1 Nonimmigrant with an unexpired I-94 (a)(18)
  • Spouse of certain H1B principal nonimmigrants with an unexpired I-94 showing H4 (2)(26)

    Pls note OPT extension is not eligible for a 540-day auto extension. OPT extension has a 180-day auto extension instead.
