Biotech Researcher turned Financial Adviser Obtained NIW approval

Dr. Chen has extensive analytical research experience in biopharmaceutical. He holds a PhD in Cell Biology from an American University and had publications, citations and paper review experience.  He has thorough understanding on biopharmaceutical industry, which offers him outstanding skills in evaluating the potentials on pharmaceutical products development.  He tried to invest in pharmaceutical companies based on his understanding of the industry and achieved remarkable profit. His knowledge and skills are so impressive that a law firm offered him a financial analyst position to provide its clients investment analysis in pharmaceutical industry. Dr. Chen decided to take the job and switch his career from a researcher to financial analyst.

This is undoubtedly a risky move to Dr. Chen’s NIW application. Dr. Chen’s contributions in research are strong to support his NIW. If he were continuing to work as a researcher, such contributions could be easily included in the petition. However, since he decided to be a financial analyst, whether his contributions as a researcher could be used in support of this NIW is challenging. In this case, USCIS needs to be persuaded that because of Dr. Chen’s contributions as a biotech researcher, he is likely to make equally or greater contributions as a financial analyst in future if he were granted the green card. To successfully achieve such claim, a link between his previous work and future job needs to be built. Having helped quite lot clients in similar situations, Attorney Feng suggested addressing whether his knowledge and skills obtained from research are applicable in financial analyst. If succeed, his previous achievements are acceptable to support his NIW even after he changed his career.

Total nine recommendation letters were submitted to demonstrate that his research experience is the key for the success in his current job. It also makes him very unique to finance sector as very few financial analysts have similar background as Dr. Chen does. Dr. Chen’s skill set is very normal in biotech research. However, the same set of skills is very unique in finance sector, which makes him extremely valuable. Attorney Feng also emphasized the benefits Dr. Chen has brought and will continue to bring that his work not only helps investors achieving profit, but also helps pharmaceutical industry obtaining financial support. Without sufficient funding, the development of innovative pharmaceutical products will be delayed. With Dr. Chen’s knowledge, investors have better understanding on the science behind the development of pharmaceuticals and are more confident to put capital in pharmaceutical industry. It is a “win win” situation, which also serves national interest. Although the fields of biopharmaceuticals and finance are totally different field, Attorney Feng found a way to show how they were linked to each other, and how the knowledge of biopharmaceuticals was critical to advise investors correctly about new potential drugs that could impact the health of the country, which is worth to be mentioned.

This NIW was approved.

Although this is not typical of all cases, it demonstrates that even weak cases can have an excellent chance of approval with the help of a highly skilled attorney. As long as you can persuasively prove that you meet the NIW requirements, you have a chance to succeed. In Dr. Chen’s case, he has benefited from the crafting of strong recommendation and petition letters, and from this sound legal advice.
